HELOC and Florida's Homestead Exemption

Three protections. One loan product. Zero interference. Here's how the Florida Homestead Exemption, Save Our Homes cap, and creditor protection each interact (or don't) with your HELOC.

Florida's three separate "homestead" protections

Most Florida homeowners conflate three different legal protections that all use the word "homestead":

1. $50,000 property tax exemption

Reduces your home's assessed value by $50,000 for property tax purposes. First $25K applies to all taxing authorities including schools. Second $25K applies to non-school taxes on assessed value between $50K-$75K. To qualify: primary residence, Florida resident, application filed by March 1.

2. Save Our Homes (SOH) 3% cap

Limits annual increases in assessed value to 3% or CPI (whichever is lower). Kicks in the year after you receive the Homestead Exemption. Reassessment resets only upon change of ownership.

3. Creditor protection (Article X §4)

Protects primary residence from forced sale by most creditors. Unlimited value protection but 0.5 acre urban / 160 acre rural size limit. Does NOT protect against voluntary liens (mortgages, HELOCs), tax liens, mechanic's liens, or homeowner association assessments.

The mechanic behind why HELOC doesn't break homestead

Florida's Homestead Exemption is based on occupancy and residency, not equity ownership percentage. You can have a $500K first mortgage, a $200K HELOC, and $0 in real equity — you still get the full Homestead Exemption. It's status-based, not equity-based.

Same logic for Save Our Homes. The cap protects the assessed value from being reset to current market value. It resets only when title transfers. A HELOC creates a lien, not a transfer.

Where homeowners get confused: HELOC on second homes or investment

If you HELOC an investment property or a second home, no homestead protection applies to that property anyway — because it's not your primary residence. Homestead protections attach to primary residence only. So opening a HELOC on your Naples vacation condo doesn't lose you homestead protection, because you never had it on that property.

The one real scenario where HELOC and homestead interact

If you're planning to sell your homesteaded home and buy another Florida homestead, the Save Our Homes benefit can be transferred (up to $500K of the benefit) under portability rules. To do this:

  • File for the new homestead within 3 years of abandoning the old one
  • Complete the DR-501T portability form with your county appraiser

A HELOC balance you carry into the transaction doesn't affect portability — but it does affect your cash-to-close on the new home, since HELOCs must be paid off before or at closing on the old home's sale. Plan the payoff sequence carefully.
